Terms of Service
Effective date: August 28, 2025
Governing law & venue: Poland (courts of Kraków).
1) What BrightMind is
BrightMind is an AI-assisted focus and coaching app that helps users get unstuck and start tasks through short voice-based sessions.
2) Using BrightMind
- You must comply with applicable laws and these Terms.
- Age: In the EEA (including Poland), you must be 16+, or have verified parental/guardian consent if younger. Outside the EEA, follow local consent ages (typically 13–16). (Linklaters, GDPR)
- Don't misuse the service (no illegal content/activity, harassment, spam, attempts to bypass security, or violating others' rights).
3) Accounts & data
- The app currently does not require an account or email.
- Voice sessions are processed in real time by our processors (LiveKit, Deepgram, OpenAI, Cartesia). See the Privacy Policy for details.
4) Payments
We may introduce paid plans later. If we do, we'll clearly describe pricing, billing cycles, and how to cancel before charges apply.
5) Third-party services
Your use of BrightMind relies on third-party processors (listed in the Privacy Policy). Their terms and privacy practices apply to their processing. (LiveKit, cartesia.ai)
6) Availability & changes
We may change, suspend, or discontinue features at any time. We may update these Terms; material changes take effect after posting.
7) Important disclaimers (minimal, protective)
- BrightMind provides supportive productivity/behavioral guidance only. It is not medical, psychological, or psychiatric advice, and it's not a crisis service.
- The service is provided "as is" without warranties of fitness, reliability, or non-infringement.
8) Limitation of liability (concise)
To the extent permitted by law, BrightMind and its providers won't be liable for indirect or consequential damages. Our total liability for any claim is limited to €50 or the amount you paid to us in the 12 months before the claim, whichever is greater. (Local mandatory consumer rights remain unaffected.)
9) Termination
We may suspend or terminate access for violations of these Terms or to protect users/security. You can stop using the app at any time.
